Former Pakistani judge has claimed that Supreme Court can order Speaker of the National Assembly, Ayaz Sadiq to move a reference in Election Commission against Prime Minister Nawaz Sharif in Panama Leaks case.
In an exclusive talk with Dunya News, Naveed Khawaja said that at most, the top court will either order to take legal action against National Accountability Bureau criminals or file a reference against the premier.
He further said that the Supreme Court would never order to establish a commission.
He said that the top has heard at least six cases of like nature during the time when former chief justice Iftikhar Muhammad Chaudhry was in service.
Explaining one such case, he said that ex-chairman of Pakistan Steel Mills was held for at least six years after cases were lodged against him. In the case concerning NICL, the top court had ordered to lodge cases as well.
In another two cases SC had ordered to file cases, he added.
At extreme, the top court will order the NA Speaker to move a reference against the premier under Article 62 and Article 63 of the Constitution of Pakistan, Khawaja Naveed said.
However, the premier can be de-seated over ECP’s action once Ayaz Sadiq pursues a reference.
Citing former premier Yousaf Raza Gilani’s dismissal, he said that though the case was different but a practice was once done in the past.
